Pogust Goodhead has filed separate proceedings against multiple musical instrument manufacturers in the Competition Appeal Tribunal, after the Competition and Markets Authority (CMA), in the summer of 2020, found these manufacturers to have infringed competition law by engaging in resale price maintenance with resellers in the UK.

It is claimed that the pricing policies implemented by these manufacturers – which include Fender, Korg, Roland, and Yamaha – have caused individuals, educational institutions, and businesses to purchase online and instore electronic musical products, and similar products supplied by other electronic musical instruments manufacturers, at less competitive and higher prices than they otherwise would have been.

Consumer rights campaigner Elisabetta Sciallis seeks to represent the class of purchasers who have suffered damages arising from the multiple Claims brought against Fender, Korg, Roland, and Yamaha.

Anyone domiciled outside the UK who purchased any of these products in the UK may also choose to be included in the Claim.

The Competition Appeal Tribunal will shortly hold case management conferences at which it will set dates for hearings to determine whether the Claims will be allowed to proceed as collective actions and to consider any objections by class members and other interested parties.
