Ser\u00e1 que a press\u00e3o interna e externa sobre o grande petr\u00f3leo se traduziu numa mudan\u00e7a significativa? Ser\u00e1 que vimos alguma indica\u00e7\u00e3o de que os super-multiplicadores de carbono est\u00e3o a mudar os seus modelos de neg\u00f3cio, ou ser\u00e1 que tais inten\u00e7\u00f5es foram descarriladas por factores sem precedentes fora do seu controlo durante os \u00faltimos 12 meses?&nbsp;&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>O impacto da &#8220;Quarta-feira Negra<\/b><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>COP26<\/b>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Houve v\u00e1rios marcos clim\u00e1ticos nos 12 meses desde a &#8220;Quarta-feira Negra&#8221;, sendo o mais significativo a COP26, que se realizou no Outono passado em Glasgow e teve os combust\u00edveis f\u00f3sseis (particularmente o carv\u00e3o) no topo da agenda.  &nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Representantes de quase 200 pa\u00edses reuniram-se para formular objectivos de combate \u00e0s altera\u00e7\u00f5es clim\u00e1ticas, com uma s\u00e9rie de planos concretos materializados no <span style=\"text-decoration: underline;\"><a style=\"color: #000000; text-decoration: underline;\" href=\"https:\/\/unfccc.int\/process-and-meetings\/conferences\/glasgow-climate-change-conference-october-november-2021\/outcomes-of-the-glasgow-climate-change-conference\">Pacto Clim\u00e1tico de Glasgow<\/a>,<\/span> que inclu\u00edam acordos para &#8220;reduzir gradualmente&#8221; a produ\u00e7\u00e3o de carv\u00e3o, reduzir as emiss\u00f5es de metano e parar a desfloresta\u00e7\u00e3o. Foram feitas promessas por pa\u00edses mais ricos para ajudar financeiramente os pa\u00edses vulner\u00e1veis na adapta\u00e7\u00e3o a um mundo menos dependente dos combust\u00edveis f\u00f3sseis<span style=\"font-size: 8pt;\">,8<\/span> e as partes concordaram em reunir-se novamente no Egipto em Novembro de 2022 para aproveitar os progressos feitos na COP26.&nbsp;&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Agora, seis meses ap\u00f3s a confer\u00eancia, tem havido poucas provas de progressos substanciais por parte dos maiores pa\u00edses poluidores<span style=\"font-size: 8pt;\">.9<\/span><span style=\"font-size: 8pt;\"> &nbsp;<\/span> <\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">O ritmo de mudan\u00e7a a n\u00edvel global \u00e9 inevitavelmente lento, mas alguns dos objectivos emergentes da COP26 parecem inconscientemente pouco ambiciosos, tais como a promessa da \u00cdndia (como o terceiro maior emissor mundial de gases com efeito de estufa depois dos EUA e da China) de atingir o zero l\u00edquido at\u00e9 2070,<span style=\"font-size: 8pt;\">10<\/span>  e as limita\u00e7\u00f5es do compromisso global de reduzir as emiss\u00f5es de metano em apenas 30% at\u00e9 2030.<span style=\"font-size: 8pt;\">11&nbsp;<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">As ambi\u00e7\u00f5es de &#8220;reduzir gradualmente&#8221; o carv\u00e3o (suavizadas em rela\u00e7\u00e3o \u00e0 redac\u00e7\u00e3o original de &#8220;eliminar gradualmente&#8221; para ganhar o apoio da \u00cdndia e da China) foram impedidas pela guerra na Ucr\u00e2nia; o aumento global dos pre\u00e7os da energia e dos alimentos significa que os recursos destinados ao financiamento clim\u00e1tico foram desviados; e a desfloresta\u00e7\u00e3o n\u00e3o mostra sinais de abrandamento.<span style=\"font-size: 8pt;\">12  &nbsp;<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Em suma, a reiterada garantia de Alok Sharma no seu discurso de encerramento na COP26 de que &#8220;estamos a fazer progressos&#8221; n\u00e3o se confirmou na realidade<span style=\"font-size: 8pt;\">.13<\/span><span style=\"font-size: 8pt;\">&nbsp;<\/span>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>Relat\u00f3rio do Painel Intergovernamental sobre Altera\u00e7\u00f5es Clim\u00e1ticas<\/b>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Isto \u00e9 confirmado por um Fevereiro de 2022 <span style=\"text-decoration: underline;\"><a style=\"color: #000000; text-decoration: underline;\" href=\"https:\/\/www.ipcc.ch\/report\/ar6\/wg2\/\">relat\u00f3rio<\/a> <\/span>pelo Painel Intergovernamental sobre Altera\u00e7\u00f5es Clim\u00e1ticas, que examinou as amea\u00e7as colocadas pelas altera\u00e7\u00f5es clim\u00e1ticas e constatou que os pa\u00edses n\u00e3o est\u00e3o a fazer o suficiente para mitigar o impacto do aquecimento global<span style=\"font-size: 8pt;\">.14<\/span> &nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Segundo o relat\u00f3rio, as \u00e1reas vulner\u00e1veis que j\u00e1 sofrem os efeitos de secas recordes, inunda\u00e7\u00f5es devastadoras e subida do n\u00edvel do mar continuar\u00e3o a sofrer desastres naturais cada vez mais frequentes, e a propaga\u00e7\u00e3o geogr\u00e1fica destes desastres est\u00e1 a expandir-se. O relat\u00f3rio foi descrito como &#8220;um atlas do sofrimento humano e uma acusa\u00e7\u00e3o condenat\u00f3ria de lideran\u00e7a clim\u00e1tica falhada&#8221; pelo Secret\u00e1rio-Geral da ONU Ant\u00f3nio Guterres e \u00e9 um aviso severo do que est\u00e1 para vir se o mundo n\u00e3o se agarrar com a sua depend\u00eancia dos combust\u00edveis f\u00f3sseis<span style=\"font-size: 8pt;\">.15<\/span><span style=\"font-size: 8pt;\">&nbsp;<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>A invas\u00e3o russa da Ucr\u00e2nia<\/b>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Outro acontecimento significativo do ano passado que est\u00e1 inextricavelmente ligado \u00e0 fortuna da ind\u00fastria dos combust\u00edveis f\u00f3sseis \u00e9 a invas\u00e3o russa da Ucr\u00e2nia a 24 de Fevereiro deste ano. A guerra precipitou uma &#8220;crise energ\u00e9tica global&#8221; e suscitou novas conversas sobre a depend\u00eancia do mundo dos combust\u00edveis f\u00f3sseis, particularmente do petr\u00f3leo e do g\u00e1s russos<span style=\"font-size: 8pt;\">.16<\/span><span style=\"font-size: 8pt;\">&nbsp;&nbsp;<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">As pot\u00eancias ocidentais comprometeram-se a reduzir as suas importa\u00e7\u00f5es de combust\u00edvel da R\u00fassia:&nbsp;&nbsp;<\/span><span style=\"font-family: monospace, monospace; font-size: 1em; white-space: pre-wrap; color: var( --e-global-color-text ); font-weight: var( --e-global-typography-text-font-weight );\">&nbsp;<\/span><\/p>\n<ul>\n<li>\n<pre><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">- The UK is committing to phasing out Russian oil in 2022;<span style=\"font-size: 8pt;\">17 &nbsp;<\/span><\/span><\/pre>\n<\/li>\n<li>\n<pre><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">- The US is banning imports of Russian oil, liquified natural gas and coal;<span style=\"font-size: 8pt;\">18 &nbsp;<\/span><\/span><\/pre>\n<\/li>\n<li>\n<pre><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">- and the EU is moving toward a total import ban.<span style=\"font-size: 8pt;\">19&nbsp;<\/span><\/span><\/pre>\n<\/li>\n<\/ul>\n<pre><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Corporations have also moved away from Russian oil, with international oil majors like Shell Plc and Total Energies SE pledging to stop sourcing oil from Russia altogether.<span style=\"font-size: 8pt;\">20<\/span> <\/span><\/pre>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Embora as exporta\u00e7\u00f5es de combust\u00edveis f\u00f3sseis tenham sido reduzidas por tais medidas, a continua\u00e7\u00e3o da depend\u00eancia global do petr\u00f3leo e g\u00e1s russos significa que a R\u00fassia pode cobrar tarifas mais elevadas <span style=\"font-size: 8pt;\">22<\/span>,&nbsp; criando um &#8220;catch-22&#8221; em que as san\u00e7\u00f5es impostas \u00e0 R\u00fassia contribuem para o aumento dos pre\u00e7os dos combust\u00edveis para os pa\u00edses que imp\u00f5em tais san\u00e7\u00f5es.&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">O verdadeiro impacto dos boicotes e embargos ainda n\u00e3o se fez sentir, no entanto, com as receitas do petr\u00f3leo russo a aumentarem 50% nos primeiros meses de 2022<span style=\"font-size: 8pt;\">.21<\/span><span style=\"font-size: 8pt;\">&nbsp;<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">A guerra tem sido apresentada por alguns como uma oportunidade para se afastar completamente da depend\u00eancia dos combust\u00edveis f\u00f3sseis. Os c\u00e9pticos notam que a pandemia de Covid-19 apresentou uma oportunidade semelhante, que acabou por ser desperdi\u00e7ada \u00e0 medida que o consumo de energia regressava aos n\u00edveis pr\u00e9-pand\u00e9micos, ap\u00f3s um mergulho de curta dura\u00e7\u00e3o<span style=\"font-size: 8pt;\">.23<\/span> &nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">No entanto, tem havido alguma ret\u00f3rica mais optimista, como a do ministro das finan\u00e7as da Alemanha, que regista a inten\u00e7\u00e3o do pa\u00eds de acelerar o investimento em energias renov\u00e1veis, chamando \u00e0 energia limpa a &#8220;energia da liberdade&#8221;.<span style=\"font-size: 8pt;\">24<\/span> O sentimento de urg\u00eancia em torno da transi\u00e7\u00e3o para longe das fontes de energia russas tem o potencial de ser enquadrado como um afastamento geral dos combust\u00edveis f\u00f3sseis, e um impulso adicional para investir em energia mais limpa e mais verde.&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>As consequ\u00eancias da decis\u00e3o da Shell?  <\/b>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Na sequ\u00eancia da decis\u00e3o do tribunal holand\u00eas de Maio passado, a Shell confirmou que iria apresentar um recurso<span style=\"font-size: 8pt;\">,25<\/span> o que fez a 22 de Mar\u00e7o de 2022.<span style=\"font-size: 8pt;\">26<\/span> Isto foi seguido de uma carta dos requerentes (Amigos da Terra\/Milieudefensie) a 24 de Abril aos conselhos de administra\u00e7\u00e3o da Shell e representantes individuais, incluindo o CEO Ben van Beurden, alegando que a empresa n\u00e3o estava a agir para implementar o veredicto pendente de recurso.<span style=\"font-size: 8pt;\">27<\/span> (O tribunal tinha deixado claro que a sua decis\u00e3o era provisoriamente execut\u00f3ria e tinha, portanto, um efeito imediato, apesar de qualquer recurso que a Shell pudesse interpor.<span style=\"font-size: 8pt;\">28<\/span>)&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Desde a decis\u00e3o, a Shell mudou tamb\u00e9m a sua sede para o Reino Unido, uma decis\u00e3o que eles alegavam que &#8220;tornaria a empresa mais \u00e1gil, melhorando a sua capacidade de responder \u00e0s exig\u00eancias da transi\u00e7\u00e3o&#8221;.<span style=\"font-size: 8pt;\">29<\/span>  Contudo, isto tem sido visto por alguns como um reflexo da deteriora\u00e7\u00e3o das rela\u00e7\u00f5es com o governo holand\u00eas na sequ\u00eancia da decis\u00e3o do tribunal.<span style=\"font-size: 8pt;\">30<\/span>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Relativamente, a 15 de Mar\u00e7o de 2022, ClientEarth lan\u00e7ou uma ac\u00e7\u00e3o judicial contra o Conselho de Administra\u00e7\u00e3o da Shell nos tribunais ingleses, procurando responsabilizar a empresa por gerir mal o risco clim\u00e1tico e n\u00e3o se preparar para a transi\u00e7\u00e3o para fontes de energia mais sustent\u00e1veis.<span style=\"font-size: 8pt;\">31<\/span> Est\u00e3o a desafiar a administra\u00e7\u00e3o da Shell utilizando uma &#8220;ac\u00e7\u00e3o derivada&#8221;, que \u00e9 uma queixa apresentada por um accionista em nome da empresa.<span style=\"font-size: 8pt;\">32<\/span> &nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">Argumentam que, ao n\u00e3o adoptar e implementar uma estrat\u00e9gia clim\u00e1tica que se alinha significativamente com o objectivo do Acordo de Paris de manter o aumento da temperatura global abaixo de 1,5\u00b0C at\u00e9 2050, o Conselho de Administra\u00e7\u00e3o violou os seus deveres ao abrigo das sec\u00e7\u00f5es 172 e 174 da Lei das Empresas do Reino Unido (UK Companies Act), que legalmente lhe exige que actue de forma a promover o sucesso da empresa, e que exer\u00e7a razo\u00e1vel cuidado, per\u00edcia e dilig\u00eancia.&nbsp;&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">As ac\u00e7\u00f5es judiciais contra empresas t\u00eam normalmente representado at\u00e9 \u00e0 data uma pequena propor\u00e7\u00e3o de lit\u00edgios clim\u00e1ticos baseados em direitos, mas como mostra a ac\u00e7\u00e3o de ClientEarth contra a Shell, este tipo de casos est\u00e1 a tornar-se cada vez mais comum<span style=\"font-size: 8pt;\">.33<\/span> &nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\"><b>O crescimento de lit\u00edgios relacionados com o clima contra empresas<\/b>&nbsp;<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 12pt; font-family: Georgia, Palatino;\">O crescimento de lit\u00edgios relacionados com o clima contra empresas \u00e9 uma das tomadas de posi\u00e7\u00e3o positivas dos \u00faltimos 12 meses.
