The UK mediation between legal representatives for claimants and British Airways Plc was resolved on confidential terms.\u00a0<\/span><\/p>\n

Harris\u00a0Pogust<\/a>,\u00a0<\/span>PGMBM\u00a0Chairman<\/span>,\u00a0said: \u201cWe are very pleased to have come to a resolution on this matter after constructive mediation with British Airways. This represents an extremely positive and timely solution for those affected by the data incident.\u201d<\/span>\u00a0<\/span><\/p>\n

British Airways Data Breach: Case history<\/span><\/b>\u00a0<\/span><\/h4>\n

British Airways\u00a0<\/span>revealed<\/span>\u00a0on 7 September 2018 that there had been a breach of its security systems, leading to over 420,000 customers and staff having their personal data leaked.\u00a0<\/span>\u00a0<\/span><\/p>\n

This\u00a0included\u00a0names, debit and credit card numbers, addresses,\u00a0and email addresses.<\/span>\u00a0<\/span><\/p>\n

In July 2019, the Information Commissioner\u2019s Office (ICO) issued a<\/span>\u00a0<\/span><\/a>notice<\/span><\/a>\u00a0of its intention to fine British Airways \u00a3183million for infringements of the General Data Protection Regulation (GDPR).\u00a0<\/span>\u00a0<\/span><\/p>\n

However, in October,\u00a0the ICO\u00a0<\/span>revised<\/span><\/a>\u00a0the fine down to \u00a320million\u00a0having considered representations from BA and the impact of Covid-19 on the business.<\/span>\u00a0<\/span><\/p>\n

PGMBM<\/span><\/b>\u00a0and British Airways\u00a0<\/span><\/h4>\n

The\u00a0<\/span>PGMBM<\/span>\u00a0team, led by Legal Director\u00a0<\/span>Tony Winterburn<\/span><\/a>\u00a0and\u00a0Associate\u00a0<\/span>Michael Burke<\/span><\/a>,\u00a0filed a claim on behalf of those affected in April 2020, and have welcomed the\u00a0resolution.\u00a0<\/span>\u00a0<\/span><\/p>\n

The resolution includes the provision for compensation for qualifying claimants who were part of the litigation but does not include any admission of liability by British Airways Plc.<\/span>\u00a0<\/span><\/p>\n

\u201cThe Information Commissioner\u2019s Office laid out how BA did not take adequate measures to keep its passengers\u2019 personal and financial information secure,\u201d Harris Pogust<\/a> said.<\/span>\u00a0<\/span><\/p>\n

\u201cHowever, this did not provide redress to those affected. This settlement now addresses that.\u201d<\/span>\u00a0<\/span><\/p>\n

The easyJet claim\u00a0<\/span><\/b>\u00a0<\/span><\/h4>\n

As well as being the court-appointed lead solicitors in\u00a0the\u00a0British Airways\u2019<\/a> data breach\u00a0case, PGMBM\u00a0is\u00a0also representing growing numbers of claimants in a case relating to a similar\u00a0<\/span>data breach by\u00a0easyJet<\/span><\/a>, first revealed in May 2020.\u00a0<\/span>\u00a0<\/span><\/p>\n

The breach\u00a0saw nine million passengers\u2019 data exposed, including names, email addresses,\u00a0and travel information.<\/span>\u00a0<\/span><\/p>\n

Harris\u00a0added: \u201cThe pace at which we have been able to resolve this process with British Airways has been particularly encouraging and demonstrates how seriously the legal system is taking mass data incidents.\u00a0<\/span>\u00a0<\/span><\/p>\n

\u201cThis is a very positive sign as we look ahead to what will be an even bigger case against\u00a0easyJet relating to their 2020 data breach, as well as other similar international actions.\u201d<\/span>\u00a0<\/span><\/p>\n
